Ark owned an industrial sand pit, which it leased to Bradley Demolition & Construction, LLC (“BD&C”). Ark alleged the lease was oral only, for a term of five years with no option to renew.

It would appear that two of the applicants for sand pit licences had been Police Commissioner (ag) Clifton Hicken and Deputy Police Commissioner Calvin Brutus.
